Family Drug and Alcohol Court (FDAC)

What is it? 

FDAC is a specialist approach within family law and the family court relating to public law care proceedings and pre proceedings. Following successful pilot schemes in other parts of the country it is now available for families in the Liverpool City region who live within Liverpool City Council area. It may extend to other North West local authorities in the future.  

FDAC’s approach is solution based. The intention is to resolve the concerns that led to local authority involvement.  

Despite being named ‘Family Drug and Alcohol Court’; don’t let that mislead you! FDAC is designed to support parents and families that might struggle with a variety of difficulties.  

These difficulties can include –  

  • Drug misuse, 

  • Alcohol misuse,  

  • Mental health difficulties 

  • Experiences of domestic abuse.  

How does it work?  

Families are assessed by the social worker as to their suitability to engage with FDAC, there has to be a very clear willingness to engage with all support on offer.  

If a family is deemed suitable, a plan will be developed by the family and relevant professionals. The aim of the plan will be to solve the specific issues that the family face. 

There will be a series of assessments to continue to identify the family’s strengths and areas that need to improve and where support may still be required  

Every FDAC case which is before the court has a designated Judge. The Judge will review the matter every 14 days with the family This will be at a hearing called a Non-Lawyer Review Hearing. It is a chance for parents to speak directly to the Judge. Parents are entitled to legal representation throughout this process, legal aid is non means and non-merits tested, it is automatic for such cases.  

At the end of the process, the FDAC team will give recommendations to the Local Authority and court as to whether parents can safely, care for the child(ren). 

Who might be involved in the FDAC team 

  • A Judge 

  • Substance misuse professional,  

  • Domestic violence and abuse professional,  

  • Mental health professional,  

  • Therapist,  

  • Psychiatrist if necessary 

  • Social worker, and  

  • Parent mentors.   

Professionals involved are specifically trained to motivate, encourage and engage parents.  

Professionals do not ‘judge’, they are there to give practical and emotional support to help parents and families overcome the issues which cause a risk to the child(ren) .  

How can it assist? 

FDAC can provide parents with the opportunity to develop a collaborative working relationship with independent professionals, the Local Authority (social services) and Judges.

FDAC allows parents and professionals to work closely, under a personalised plan of action.

  • Are you wanting an opportunity to prove your ability to care for your child(ren) safely?
