The Human Rights Act 1998 ensures that our most fundamental human rights are protected, for example, the Right to Life (Article 2), the Right to a Fair Trial (Article 6) and the Right to Respect for Private and Family Life (Article 8) to name a few. These rights are applied to each and every one of us, so when they are breached, legal action must be taken.

Understanding the issue
We advise and act for clients in a broad range of Human Rights cases and quite often each case can involve a breach of more than one of those rights. This can be a range of issues, for example, mistreatment of prisoners, unlawful detention, failure to take children in to care, or a misuse of personal data.
MSB has an in-depth knowledge in all areas of Human Rights law. It is very important to act quickly in Human Rights cases as there is a 12-month time limit in which the claim must be issued regardless of the age of the person making the claim. We will act on your behalf to ensure that the right resolution is reached.

Funding options
We can offer various methods of funding to our public law clients. The most common method is legal aid as MSB has the benefit of contracts from the Legal Aid Agency for Public Law and also Actions Against Public Authorities. Such funding is subject to assessment of the financial means of a client, and also the merits of a case.
For those clients and cases where Legal Aid is not available, matters can be paid for privately. Depending upon the nature of the instructions we are also able to give consideration to damages-based agreement and no win no fee agreements.
