Landlord Possession ProceduresGETTING BACK YOUR PROPERTY ASSURED SHORTHOLD TENANCIES

Broadly speaking possession proceedings are mostly commenced when either of the following occurs :

1. Your tenants falls behind with their rent and are in arrears during the course of their Assured Shorthold Tenancy or
2. The Assured Shorthold Tenancy has come to an end and the tenants refuse to give up possession of the property.

NON PAYMENT OF RENT

If a tenant pays their rent on a monthly basis, once they are 2 months in arrears you can commence possession proceedings. A section 8 notice needs to be served on the tenant and court proceedings can be commenced 2 weeks later.

POSSESSION AT THE END OF AN ASSURED SHORTHOLD TENANCY

A Section 21 Notice must be served on the tenant. This can be done when the tenancy commences by you or your letting agent. If the notice is not served at the commencement of the tenancy this should be done at least 2 months prior to the end of the tenancy agreement. Provided a valid notice has been served then court proceedings can be issued immediately. This is called the Accelerated Possession Procedure. If the correct notice has not been served then we can do this for you.

Possession proceedings under the Accelerated Procedure are quicker and usually dealt with without a hearing. However, please note, if the tenant has paid a deposit at the commencement of the tenancy and this has not been placed in an approved government scheme, the Accelerated procedure cannot be used.

TAKING BACK YOUR PROPERTY

The tenant should leave the property on the date the possession order states. If the tenant fails to give up possession we can instruct a Court Bailiff to attend the property to regain possession for you.

Mark Forman Mark Forman - Partner

Mark attended Birmingham University from where he obtained a law degree, LLB Hons 2:1 and qualified as a Solicitor in 1994.

From there Mark trained with Martineau Johnson in Birmingham, and then Cuff Roberts and Weightmans in Liverpool.  He then set up his own firm with Neil Kelly and then joined MSB.

Mark lives in Liverpool with his wife and 3 children and follows football (LFC) and cricket.

Mark deals with commercial law; commercial litigation and employment matters.

Tracey SkynerTracey Skyner - Partner

Tracey undertook her training contract with MSB and qualified as a Solicitor in June 2004. Tracey became an Associate Solicitor in June 2006 after only 2 years of qualifying and was made a Partner in 2008.

Tracey currently heads the Firms Investment Department in the Allerton Road Branch and specialises in property matters including buy to let investments.  Tracey also deals with Residential Landlord and Tenant matters.

Tracey sits on the committee and is Vice Chair for the Association of Women Solicitors.

Tracey lives in Liverpool with her husband and what little time Tracey has free she still finds time to socialise with her friends and travel to far off places.

Tracey is now on maternity leave until December 2012.

Charlie MahoneyCharlie Mahoney - Trainee Solicitor

Charlie joined the MSB team in August 2009 after graduating from the University of Liverpool with an LLB degree in English and French Laws with French. Charlie has subsequently undertaken the LPC part time course at The College of Law in Chester.

Charlie is currently based within the MSB Personal Injury department.

Outside of work, Charlie is a keen football fan and enjoys a variety of music, as well as cooking and eating out with friends.

Danielle Blaylock Danielle Blaylock - Litigation Executive

Danielle joined the firm in August 2010 and assists with Debt Recovery and Enforcement, Bankruptcy and Insolvency proceedings. Danielle graduated from The University of Central Lancashire in 2007 with her Law and Criminology degree and then proceeded to successfully complete her Ilex examinations. In her spare time Danielle enjoys socialising with friends, attending the theatre and studying historical novels.
