SERIOUS FRAUD

The Legal Services Commission recognised in May 2003 that MSB Solicitors have many years experience of defending individuals charged with serious and complex fraud throughout the UK. MSB Solicitors were therefore approved by the LSC as members of the Specialist Fraud Panel. The LSC has subsequently contracted with MSB Solicitors on a number of occasions to represent Defendants charged in serious high cost fraud cases. FACING DISQUALIFICATION FROM DRIVING

We continue to represent clients on a nationwide basis who face disqualification from driving, either as a result of speeding, totting-up for other motoring offences or drinking and driving.

Sean Sexton identified a loophole in the law relating to persons suspected of drinking and driving who then failed to provide a specimen of breath for analysis by the police. We successfully argued that the standard wording of such charges was void for duplicity in DPP –v- Corcoran and many of our clients subsequently had their disqualification’s from driving for such offences overturned on appeal. We continue to specialise in representing clients at risk of losing their employment as a result of a disqualification from driving and have particular expertise in technical defences, exceptional hardship submissions and submissions of special reasons why disqualification should not be imposed.
